Terms of Service

1. Who we are and what these terms cover

FasterMenu (“FasterMenu”, “we”, “us”) provides an online service for creating, hosting and sharing digital restaurant menus, available at fastermenu.com and its subdomains (the “Service”).

These Terms of Service (the “Terms”) are a binding agreement between you and FasterMenu. By creating an account, signing in, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of a business, you confirm that you are authorised to bind that business, and “you” refers to that business.

2. The Service

The Service lets you build a digital menu from templates or with AI assistance, host it on a FasterMenu subdomain you choose (e.g. your-restaurant.fastermenu.com), share it via link or QR code, and view anonymised engagement statistics about how diners use your menu.

We may add, change or remove features of the Service at any time. If a change materially reduces the core functionality you pay for, we will use reasonable efforts to notify you in advance.

3. Accounts

You must provide a valid email address to create an account; we sign you in with secure email links instead of passwords. You are responsible for keeping access to your email account secure and for all activity that happens under your FasterMenu account.

The Service is intended for business use by restaurants and food businesses. You must be at least 18 years old (or the age of majority where you live) to create an account.

4. Free trial, subscriptions and billing

New accounts start with a free trial (currently 30 days). A valid payment card is required to start the trial, but you are not charged during it. When the trial ends, your subscription starts automatically and your card is charged on a recurring basis at the plan price shown at signup, unless you cancel before the trial ends.

Payments are processed by Stripe; we do not store your card details. Subscriptions renew automatically each billing period until cancelled. You can cancel at any time from your dashboard — cancellation takes effect at the end of the current billing period, and already-paid fees are non-refundable except where required by law.

We may change our prices. Price changes apply from your next billing period and we will notify you reasonably in advance.

5. Your content

You keep all rights to the content you add to the Service — menu text, prices, photos, logos and branding (“Your Content”). You grant us a worldwide, non-exclusive licence to host, store, process, reproduce and display Your Content solely to operate and improve the Service, including serving your public menu to diners.

You are responsible for Your Content. That includes having the rights to everything you upload, and making sure the information your menu shows to diners — prices, ingredients, allergen and dietary information — is accurate and complies with the laws that apply to your business.

6. AI features

The Service includes AI-assisted features such as importing a menu from photos, generating dish descriptions and images, and the “Ask the menu” assistant for diners. Content you submit to these features may be processed by third-party AI model providers on our behalf, as described in our Privacy Policy.

AI output can be wrong. You must review AI-generated content — especially prices, allergen and dietary tags — before publishing it. You are responsible for everything your published menu states, regardless of whether it was written by you or generated by AI.

AI features are subject to fair-use quotas that depend on your plan. We may adjust quotas to keep the Service reliable for everyone.

7. Acceptable use

When using the Service, you must not:

  • break any applicable law or regulation;
  • upload content that is unlawful, deceptive, infringing, or that you do not have the rights to use;
  • choose a menu address (subdomain) that infringes someone else’s trademark or impersonates another business — we may reclaim or reassign such addresses;
  • attempt to probe, disrupt or overload the Service, circumvent usage quotas, or access other customers’ data;
  • resell, sublicense or white-label the Service without our written permission; or
  • use automated means to scrape the Service beyond what public menus reasonably allow (e.g. search engine indexing).

8. Intellectual property

The Service itself — including the software, menu templates, designs and branding — belongs to FasterMenu and its licensors. These Terms do not give you any rights in the Service other than the right to use it while your subscription is active. Feedback you send us may be used without obligation to you.

9. Termination

You can stop using the Service and cancel your subscription at any time. We may suspend or terminate your account if you materially breach these Terms, if required by law, or if your subscription remains unpaid after we notify you.

When your account ends, your published menus go offline. We may delete Your Content after a reasonable period following termination, as described in our Privacy Policy — export anything you need before cancelling.

10. Disclaimers

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, or that AI-generated content will be accurate.

11. Limitation of liability

To the maximum extent permitted by law, FasterMenu will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for all claims arising out of or relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.

12. Indemnification

You will indemnify and hold FasterMenu harmless from claims, damages and expenses (including reasonable legal fees) arising from Your Content, your use of the Service in breach of these Terms, or your violation of applicable law — including claims by diners relating to the accuracy of allergen, dietary or pricing information on your menu.

13. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will notify you by email or in the app before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.

14. Governing law and contact

These Terms are governed by the laws of the jurisdiction in which FasterMenu is established, without regard to conflict-of-law rules, and disputes will be resolved in the courts of that jurisdiction, unless mandatory consumer law where you live says otherwise.
